GDA pressures builders with threat to seal flats

Home-owners in scores of housing societies in Indirapuram have been served notices by the Ghaziabad Development Authority that their flats will be seized unless deeds of declaration are submitted to the civic agency.

The notices have baffled home-owners as such deeds have to be submitted by the housing society, not individual flats. But for the GDA, the move to serve individual notices was perhaps meant more as a pressure tactic.

The authority said on September 4 it has received deeds of declaration from developers of more than 50 housing societies since the notices were first served in April and then again in July.

“It’s unfathomable why flat owners should be threatened when the deeds are not in their possession. The authority has no statutory right to threaten or punish flat owners for the lapses of developers,” said Achyut Rao of the DesignArch Housing Society.

The declaration is essentially a form containing details of a housing project, including land titles, total number of flats, common area, facilities and parking space. The UP Apartment Act, 2010, makes submission of such deeds mandatory.

In notices issued to housing societies, the GDA has informed that the action has been initiated according to an Allahabad high court order in November 2013.

The court had directed developers to submit deeds of declaration of projects whose layouts were approved after the UP Apartment Act was notified in 2011 within a period one month.

The court had similarly directed submission of deeds of those projects whose layouts were approved before notification of rules within a period of 90 days.

“Developers are being asked to submit the forms within 15 days,” said SP Gupta, officer on special duty, Ghaziabad (Indirapuram Zone).
